Terms & Conditions
Introduction
These terms and conditions govern the use of the Question Bank and practice exam for the CFA ESG Investing certificate and for the Sustainability and Climate Risk certificate (“Product”) offered by FGW. By accessing and using the Product, you agree to be bound by these terms and conditions. If you do not agree to these terms and conditions, you must not use the Product.
Access to the Product
Upon payment of the applicable fee, FGW grants you a limited, non-exclusive, non-transferable license to access and use the Product for the purpose of preparing for the relevant exam.
Use of the Product
You agree to use the Product only for lawful purposes and in accordance with these terms and conditions. You may not:
- reproduce, duplicate, copy, sell, trade, or resell the Product;
- use the Product for any commercial purpose or for the benefit of any third party;
- modify, adapt, translate, reverse engineer, decompile, or disassemble the Product;
- remove any proprietary notices or labels from the Product; or
- use the Product in any manner that could damage, disable, overburden, or impair Futuregreenworld 's servers or networks.
Intellectual Property
The Product is the property of FGW and is protected by intellectual property laws. You acknowledge that FGW retains all right, title, and interest in and to the Product, including all patents, trademarks, trade secrets, copyrights, and other proprietary rights. You agree not to take any action that would harm Futuregreenworld's rights in the Product.
Disclaimer of Warranty
FGW makes no representations or warranties of any kind, express or implied, as to the operation of the Product or the information, content, materials, or products included on the Product. To the fullest extent permissible by law, FGW disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose.
Limitation of Liability
FGW will not be liable for any damages of any kind arising from the use of the Product, including but not limited to direct, indirect, incidental, punitive, and consequential damages.
Success Pass Guarantee
FGW offers a Success Pass Guarantee to its customers who have used the Question Bank and practice exam and failed the relevant exam. If you have failed the relevant exam and have registered to take the exam again within 6 months, FGW will grant you access to the Question Bank and practice exam for free. This guarantee is subject to the following conditions:
You must provide proof of failure in the relevant exam;
You must have used the Question Bank and practice exam in its entirety and have taken all practice exams; and
You must register for the relevant exam within 6 months of the date of your failed exam.
Termination
FGW may terminate your license to use the Product at any time and for any reason. Upon termination, you must destroy all copies of the Product in your possession.
Governing Law
These terms and conditions are governed by and construed in accordance with the law of England and Wales. In the event of any legal dispute regarding the use of the QBank and practice exam, the courts of England and Wales shall have exclusive jurisdiction to hear the case.
Changes to Terms and Conditions
FGW reserves the right to modify these terms and conditions at any time and without notice. Your continued use of the Product after any changes to these terms and conditions are posted will be deemed as acceptance of those changes.
Entire Agreement
These terms and conditions constitute the entire agreement between you and FGW and supersede all prior agreements and understandings, whether written or oral, relating to the use of the Product.
Severability
If any provision of these terms and conditions is found to be invalid or unenforceable, such provision will be severed and the remaining provisions will remain in full force and effect.
Waiver
The failure of FGW to enforce any right or provision in these terms and conditions shall not constitute a waiver of such right or provision unless acknowledged and agreed to by us in writing.
